Terms of Use

1. Agreement and company details

JOYTELLECT LTD (“JoyTellect”, “we”, “us”, “our”) is a company registered in England and Wales with company number 17040270 and registered office at Office 34a Business Centre, 9 Lydden Road, London SW18 4LT, United Kingdom.

These Terms apply to joytellect.com and to JoyTellect Skin Maker, published as “AI Skin Maker & Editor” on the Apple App Store and “Skin Maker & 3D Editor” on Google Play, including renamed or successor versions (together, the “Apps”).

By downloading, installing, accessing or using an App, you agree to these Terms. If you do not agree, do not use the Apps. The applicable App Store, Google Play or other authorised storefront terms also apply to your download and purchases.

2. Eligibility and minors

The Apps are general-audience products and are not directed to children under 13. An app-store age rating describes content suitability and is not a statement that the App is directed to children. If you are under the age of legal majority where you live, you may use an App only with the involvement and permission of a parent or legal guardian. The parent or guardian is responsible for supervising use and purchases and for enabling platform parental controls.

If local law sets a higher minimum age for a feature, consent or transaction, that higher age applies. Do not use an App where its content rating or these Terms make you ineligible.

3. Licence

Subject to these Terms and the applicable store rules, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use an App on devices you own or control for your personal, non-commercial entertainment or creative use.

For an App obtained through Apple, the licence is limited to Apple-branded products that you own or control and as permitted by the Apple Media Services Terms and Usage Rules, including Family Sharing or volume purchasing where applicable. For an App obtained through Google Play, use is also subject to Google Play’s terms.

4. Restrictions and fair use

Except where applicable law expressly permits and cannot be restricted, you must not:

• copy, modify, translate, adapt, reverse engineer, decompile, disassemble, derive source code from, or create derivative works of an App or our server software;
• sell, rent, lease, sublicense, distribute, transfer, publicly perform or commercially exploit an App or access to it;
• remove or alter copyright, trade mark, attribution, security or proprietary notices;
• circumvent technical protection, purchase, subscription, entitlement, rate-limit, advertising or anti-fraud mechanisms;
• use bots, exploits, unauthorised software, automation or modified clients, or interfere with an App, its services, networks or another user’s experience;
• scrape, mine or access an App or website by automated means in a manner that burdens systems, bypasses access controls or violates law;
• use an App to infringe intellectual-property, privacy, publicity or other rights, or for unlawful, fraudulent, abusive, hateful, threatening or harmful activity; or
• encourage or assist anyone to do any of the above.

5. Accounts and local saves

JoyTellect does not currently require or provide a JoyTellect account. Created content is stored locally on the device unless an App expressly states otherwise. Removing an App, clearing local data, replacing a device or losing access to the device may permanently remove content. You are responsible for keeping any exported copy you need.

6. Content you create

As between you and JoyTellect, you retain rights in original skins, designs, templates and other content you create using an App (“User Content”). We do not claim ownership merely because you create or save it locally.

You are responsible for User Content and must have the rights needed to create, export, upload or share it. Do not copy or distribute characters, logos, art, music or other material unless permitted by the owner or applicable law. A third-party platform may remove content or restrict your account under its own rules.

If you initiate an export or share through the operating system, you grant us only the limited rights technically necessary to prepare and transmit the selected file at your direction. The destination service’s terms govern once it receives the file.

7. Our intellectual property

The Apps, website, software, source and object code, user interface, supplied artwork, templates, text, trade marks, logos and other materials are owned by or licensed to JoyTellect and protected by intellectual-property law. No right is granted except the limited licence in these Terms.

Templates supplied in an App may be used to create personal projects as the App permits. They may not be extracted, repackaged or redistributed as a competing asset or template library.

8. Third-party platforms and trade marks

The Apps create files compatible with Minecraft: Bedrock Edition. JoyTellect is an independent developer and is not affiliated with, endorsed by, sponsored by or associated with Mojang Studios or Microsoft Corporation. Minecraft-related names and marks belong to their respective owners and are used only to describe compatibility.

You must obtain and use any third-party platform account or software legitimately and comply with that platform’s terms, community rules, technical requirements and content policies. We do not control third-party changes and cannot guarantee continuing compatibility.

9. Advertising

The Apps may display third-party advertising, including rewarded, interstitial, banner or other formats. An ad may link to content operated by an advertiser. JoyTellect does not control an advertiser’s product, claim, website or transaction. Advertising and tracking choices are described in our Privacy Policy and can be reviewed or changed through Privacy Choices in the App where consent-based processing applies.

A reward is granted only when the App and advertising service confirm completion. We may correct duplicated, fraudulent or technically invalid rewards. Paid functionality will not be conditioned on consenting to unnecessary tracking where prohibited by law or store policy.

10. Purchases, subscriptions and free trials

The Apps may offer one-time in-app purchases, non-consumable items, subscriptions, introductory offers or free trials. Before confirmation, the purchase screen shows the applicable product, price, currency, billing period, whether and when a subscription renews, the duration and price after any free trial, and other material conditions. Subscription screens provide access to these Terms and our Privacy Policy and identify how to manage or cancel the subscription. Apple or Google processes payment and applies taxes and store terms.

• Subscriptions renew automatically. Unless cancelled, the store charges the price shown for each renewal period. The store will provide notice or obtain consent for price changes where required.
• Free trials and introductory offers. Eligibility is determined by the store. Unless cancelled before the trial or offer ends, the subscription converts to the paid plan described on the purchase screen.
• Cancellation. Manage or cancel through the store account used to purchase. Deleting an App does not cancel a subscription. Cancellation normally takes effect at the end of the current paid period unless the store states otherwise.
• Restoration. Restorable purchases can be restored using the store account and the App’s restore mechanism where applicable. Consumable items may not be restorable.
• Refunds. Refund eligibility is governed by the purchasing store’s rules and mandatory consumer law. Apple purchase requests are handled through Apple. For Google Play purchases, you may request a refund from Google or contact us with the Google Play order ID; JoyTellect can review and issue eligible full or partial refunds through Google Play tools.

Nothing in this section removes a refund, cancellation or remedy that applicable consumer law requires.

11. Updates, availability and service changes

We may provide updates, patches or new versions and may require an update for security, compatibility or continued access. You authorise the applicable store or device settings to download updates as configured. We may change features, content or technical requirements, or suspend an App for maintenance, security or legal reasons.

We may discontinue an App or online feature. Where reasonably practicable, we will give advance notice of a material discontinuation affecting paid ongoing access and provide any remedy required by applicable law. We do not guarantee that an App will support every device, operating-system version or future third-party platform format.

12. Support and feedback

Support is provided through https://joytellect.com/contact/. We do not promise a particular response or resolution time unless law requires one. If you send ideas, suggestions or feedback, you grant us a non-exclusive, worldwide, royalty-free licence to evaluate, use and incorporate it to operate, improve and promote our products. You retain ownership of your feedback and unrelated User Content.

13. Privacy

Our Privacy Policy explains what data is processed, including by analytics, diagnostics, attribution, push and advertising providers, and how to exercise privacy choices. It is not incorporated as a waiver of any statutory privacy right.

14. Suspension and termination

You may stop using an App at any time. We may suspend or terminate access to an online feature or this licence where you materially or repeatedly breach these Terms, commit fraud, threaten security, infringe rights, fail to pay, or where suspension is reasonably necessary to comply with law or protect users or the service.

Where appropriate and legally required, we will consider the seriousness, recurrence and impact of the conduct and may provide notice or an opportunity to appeal by contacting support. Immediate action may be taken for urgent security, fraud, legal or safety risks.

On termination, you must stop using the affected App. Terms that by their nature should survive—including ownership, payment obligations, disclaimers, liability, dispute and Apple addendum provisions—remain effective. Termination does not automatically cancel a store subscription; cancel it through the store.

15. Warranties and disclaimers

Nothing in these Terms excludes a warranty, guarantee or statutory right that cannot lawfully be excluded. Subject to that rule, the Apps are provided “as is” and “as available”. We do not promise uninterrupted, error-free or permanently available operation, that all defects will be corrected, or that an App will remain compatible with every device, operating system or third-party platform.

You are responsible for device security, backups and compliance with third-party rules. Third-party advertisements, websites, products and services are not endorsed or warranted by JoyTellect merely because they are displayed or linked.

16. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability or statutory right that cannot lawfully be excluded or limited.

If we fail to comply with these Terms, we are responsible for loss or damage that is a reasonably foreseeable result of that failure. Loss or damage is foreseeable if it was obvious that it might occur or if, when the agreement was made, both you and we knew it might occur.

The Services are provided for personal and non-commercial use. We are not responsible for business losses, including loss of profit, revenue, opportunity or business interruption, arising from consumer use. We are not responsible to the extent loss results from misuse, an unsupported or materially modified device, failure to install a security update after reasonable notice, or circumstances outside our reasonable control.

17. Governing law and disputes

These Terms are governed by the law of England and Wales. If you are a consumer, this choice does not deprive you of mandatory protections of the country where you habitually live. You may bring proceedings in the courts of England and Wales or, where mandatory consumer law permits, in the courts of your home jurisdiction. We do not require individual consumers to arbitrate disputes or waive class or collective rights where such a requirement would be unlawful.

Before filing a claim, please contact support and describe the issue so the parties can try to resolve it informally. This does not suspend a limitation period or prevent urgent relief.

18. General terms

• Changes. We may update these Terms for legal, security, technical or product reasons. Material changes affecting existing rights will be notified in the affected App before they take effect where reasonably practicable. A change will not retroactively remove an accrued mandatory consumer right.
• Assignment. You may not transfer your licence. We may transfer these Terms as part of a reorganisation, financing or sale, provided this does not reduce mandatory rights. We will notify you where required.
• Severability. If a provision is unlawful or unenforceable, it will be applied to the maximum lawful extent and the remainder will continue.
• No waiver. A delay in enforcing a right is not a waiver of that right.
• Entire agreement. These Terms, the applicable purchase screen and mandatory store terms form the agreement about use of the Apps, without excluding liability for fraud or mandatory rights.
• Language. The English version controls to the extent permitted by law. A translation is provided for convenience unless local law requires otherwise.

19. Apple-specific terms

If you downloaded an App from Apple’s App Store, the following terms apply in addition to the rest of these Terms:

• These Terms are between you and JoyTellect, not Apple. JoyTellect, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App. Contact JoyTellect at the details below for support.
• If the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price paid for the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation; JoyTellect is responsible for other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty.
• JoyTellect, not Apple, is responsible for addressing claims relating to the App or your possession/use of it, including product-liability, legal-compliance and consumer-protection claims.
• If a third party claims that the App or your use infringes intellectual-property rights, JoyTellect, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim, subject to these Terms.
• You represent that you are not located in a country subject to a United States Government embargo or designated as a terrorist-supporting country, and are not listed on a United States Government prohibited or restricted parties list.
• You must comply with applicable third-party agreement terms when using the App, including wireless-data terms.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce this section against you once you accept the Terms.

These Terms supplement Apple’s Standard Licensed Application End User License Agreement and are not intended to replace it as a custom EULA unless JoyTellect expressly submits, and Apple accepts, a custom EULA for the affected App.

20. Google Play-specific terms

If you obtained an App through Google Play, these Terms are between you and JoyTellect; Google is not responsible for providing the App or support for it. Your use of Google Play and purchases made through it are also subject to the Google Play Terms of Service. Refunds, cancellations, subscription management and restoration are handled as described in section 10 and through the applicable Google Play tools, without limiting mandatory consumer rights.
